Applicable law and venue
The laws of the State of New Hampshire, United States of America, without regard to principles of conflict of laws, govern these Terms of Use and any dispute that might arise between you and Sprague.  If you take legal action relating to these Terms of Use, you agree to file such action either in the Superior Court for Rockingham County, State of New Hampshire, or the United States District Court for the State of New Hampshire and in no other venue, and you consent and submit to the personal jurisdiction of those courts for the purposes of litigating any such action.

Recordings
You agree that Sprague may electronically record, archived, monitored, review or disclose all Conversations between Sprague and your agents and employees regarding any commercial business between the parties, without any special or further notice to you. For purposes of this section “Conversations” shall include all telephone conversations, instant messaging or use of technology to communicate including, but not limited to, live ‘chat”. You warrant that you have all necessary consents of your agents and employees to agree to this provision.

How we safeguard your information
We restrict access to information about you to those Sprague employees who need to know the information in order to perform their jobs, such as servicing your accounts or notifying you of new products and services.  To protect your information, we maintain physical, electronic, and procedural safeguards in keeping with industry standards and practices, and we review and adjust these safeguards regularly in response to advances in technology.

Sprague Real-Time® Pricing Platform - SMS/Text

1. As a user of the Sprague Real-Time® Pricing Platform you will have the option of choosing to receive text messages in relation to Price Alerts.  When setting the alert on our platform, you must select the Text Message option and enter your text enabled phone number to receive these messages.  Each time you enter an alert, you will be able to change your notification preferences.    

2. You can cancel the SMS service at any time. Just text "STOP" to the short code. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Sprague PA Facebook Contest

NO PURCHASE NECESSARY TO PLAY/WIN A PRIZE. A PURCHASE WILL NOT IMPROVE CHANCES OF WINNING. The contest begins 2/1/21, ends once Sprague PA Facebook page hits 750 likes (the “Entry Period”). The odds of winning the gift card prize depend on the number of entries received. One winner will be chosen at the end of the promotion for a total of 1 prize. The winner will be chosen at random. The prize is valued up to $25.
 
Entries
Receive an Entry for “liking” Sprague PA’s Facebook page and sharing Sprague PA’s contest post. Receive an Entry Without Purchase (alternate method of entry “AMOE”): A Participant can request an entry without liking page or sharing post by mailing a legibly handwritten, self-addressed, stamped envelope (“SASE”) with sufficient postage and a return address, including first and last name, street address, city, state, and ZIP code to: Contest Entry Request, Sprague, 1045 W Chestnut Street, Washington, PA, 15301.  One (1) Entry will be mailed in response to each mail-in request that complies with the requirements.  Mail-in requests, including both outer envelope and SASE, must be handwritten. Outer envelope must include a return address in the upper left hand corner that matches the requestor’s street address, and must be postmarked no sooner than February 1, 2021 and no later than February 28, 2021, and received by Sponsor no later than March 15, 2021.  If the contest is extended beyond February 28, 2021, these dates are subject to a corresponding extension.  Each request must be mailed in a separate stamped outer mailing envelope. Requests that are sent in business reply envelopes, that utilize address labels or stickers (for any address), that are photocopied, hand-stamped, computer-generated or otherwise mechanically or digitally produced or reproduced, that are not mailed in separate outer stamped mailing envelopes, or that otherwise fail to comply with the Official Rules, will NOT be honored, acknowledged or returned, and the persons submitting such requests will forfeit any corresponding postage and unused envelopes.
